The two Kapamilya stars are recently in the bad light for allegedly committing election offenses.

On election day, photos of Kathryn and Daniel holding their ballots circulated on social media which garnered criticisms from the netizens.

From Mike Acebedo Lopez’s Facebook account: “Excuse me, Comelec, I thought photos with one’s ballot is a violation that carries with it a penalty of imprisonment of up to 6 years? And this girl was wearing her RoRo baller–isn’t that also a violation? Enforce the law! If violations have been committed, file cases against these two!”

The photo was originally posted on the Twitter account of ABS-CBN’s reporter, Gretchen Fulido.

According to Comelec’s spokesperson James Jimenez, KathNiel’s photo with their ballots is an election offense. Taking photos of marked or unmarked ballots and voting receipts is strictly prohibited.

On the other hand, Commisioner Rowena Ganson defended the two stars and said that a sanction is unnecessary. She noted that KathNiel’s ballots are not shaded and they weren’t the ones who took the infamous photos.

“wala namang shade. Hindi naman naka-shade ‘yung ballot. At hindi naman siya ang kumuha ng picture sa sarili niya. The voter is not allowed to use her gadget.” said Commisioner Rowena in an interview of ABS-CBN News.
